South Korean device maker says accusations ‘groundless’, prepares countersuit.

Huawei on Wednesday confirmed it has filed a patent infringement suit against Samsung relating to technology used in smartphones.

The Chinese vendor seeks unspecified compensation on the grounds that its South Korean rival is using its patented cellular communications technology in its handsets without a licence. The lawsuits have been filed in the U.S. District Court for the Northern District of California, and the Shenzhen Intermediate People’s Court.

"We hope Samsung will respect Huawei’s R&D investment and patents, stop infringing our patents and get the necessary licence from Huawei, and work together with Huawei to jointly drive the industry forward," said Ding Jianxing, president of Huawei’s intellectual property rights department, in a statement.

Huawei said it is committed to licensing its patented technology on fair, reasonable, and non-discriminatory (FRAND) terms.

Samsung has come out swinging.

"We are going to file a countersuit against Huawei," said Samsung executive vice president Ahn Seung-ho, in a Korea Times report.

According to the report, Huawei claims that Samsung smartphones, from the Galaxy S2 to the Galaxy S7 Edge, infringe upon 11 of its standard-essential patents

Samsung is currently examining the lawsuit, Ahn said, insisting that Huawei’s case is "groundless."
